That sounds nice but it is really not much different than a rule that 
says my favorite show may not be canceled in any given year.  While I 
would like to still be watching Buffy I accept the networks & 
broadcasters can choose what to display based upon market conditions.

The desire to not annoy existing customers will usually be a strong 
consideration, but not the only one.  And if the HDTV viewer 
demographics and delivery characteristics are slightly different than 
the analog then you might expect the choice of vended content might also 
be different.

So I still can't get very excited about the rule going away.
