Interesting. In the end the article correctly concludes that the FCC has no
authority to preempt states and municipalities from creating Net Neutrality
regulations if it no longer classifies ISPs as a Title II service.
Fortunately, Congress already tried to do this in the 1996 Telecom Act,
classifying broadband as an information service, and telling Federal State and
local authorities to forebear from regulation.
Given the potential mess that is brewing, its time for Congress to put an end
to this uncertainty. Legislate rules for Net Neutrality, tell us who will
enforce the rules, and preempt regulation of the Internet at every level -
Federal, State and local.
