You seem to forget the petition to the FCC by some large 
broadcast-station group owners, which was rejected not on the basis of 
MSTV or NAB but on the basis of statements from Motorola and NxtWave.

Yes.  McCain's amendment was rejected.  The Senate Commerce Committee approved 
April 7, 2009.
