Without the compulsory license they can continue to refuse to license their
content in a manner that will create real competition (Sling and Sony PSVue are
purposely crippled).
Thus, they can cut out the middlemen and operate their own VMVPD service - e.g.
Hulu live - without real Internet competition.
The Obama FCC was considering extending the compulsory license to VMVPDs;
And at the time, I said that was a non-starter. There's no reason to
duplicate legacy MVPDs on the Internet. People who bail of legacy MVPDs want
something better, as they define better, rather than a duplicate of what they
just bailed out from.
HULU Live at $40/month is clearly better than $70-100/mo for a legacy MVPD
service.
