I have my doubts as to whether this bill will be of any big help for 5G. The
big difference with 5G is the much smaller cells, much higher frequencies,
suggesting right away that "... they are serving as a replacement for an
existing small cell and they are the same or substantially similar to the
small cell that is being replaced; ..." will not, in general, be the case.
This is not like the 3G to 4G transition.
Do you remember what Commissioner O’Rielly told the wireless audience in New
Jersey Bert? This bill directly addresses the “sea anchor” that the regulatory
morass has become.
Clearly you do not understand what the authors of the bill are saying. But we
expect that of you. It simply says that small cell 5G deployments do not need
to repeat lengthy and expensive environment studies if older small cell
technologies that met the environment requirements have already been
deployed...kinda like replacing a light bulb...
I think something more specific to 5G would be more beneficial. Such as,
exempting from review towers which are erected on existing structures, such
as street lights, in a non-conspicuous way. Of course, "non-conspicuous"
would have to be clarified.
Why should the law be specific to 5G Bert? There will be many upgrades over the
next few years, and new 4G deployments that can benefit from this legislation.
The most important point here is that this is being done properly via
legislation, rather than a regulatory agency dictate, which gets tied up in the
courts for years. We can hope that Congress will resolve the Net Neutrality
debate by putting the rules into legislation.
