I want to start by saying, and emphasizing, that your work is
commendable. But I want you to take into consideration the following
points:

* The Haiku devs have made a conscious decision not to distribute Haiku
in any other form than the nightly builds coming from the build factory.
You may or may not agree with that, but it's a decision that they have
made and we would like for people to respect.

* If you want to argue that what you distribute on Haikuware is not a
distro, and that therefore the distro guidelines should not apply to
you, then you are actually admitting violating the decision of the Haiku
devs, by distributing Haiku in a different form than they intended. 

* On the other hand, if you want to create a Haiku distro, you have to
comply with the guidelines. Period.

* The burden for the compliance is on you, not on Haiku.

This could actually all be solved if you let the Haiku devs decide when,
how and where Haiku should be distributed, and focused instead on
creating application packages (that do not include Haiku itself) that
people can download and use.

Haiku already distributes nightly images for those who want to play with
Haiku. The main target audience that Haiku has at this point will build
Haiku themselves anyway.
