Howdy,

Just reading this comment on trac...

http://dev.haiku-os.org/ticket/5355#comment:1

...I became aware of the use of a "Haiku Compatible" logo in numerous entries in HaikuWare.com (apparently, mostly drivers). Here are a few entries (there are many many more):

http://www.haikuware.com/directory/view-details/drivers/audio/audigy-soundcard-driver
http://www.haikuware.com/directory/view-details/drivers/file-system/3do-cd-rom-filesystem
http://www.haikuware.com/directory/view-details/drivers/audio/auvia-driver-for-via-vt82xx-haiku-cvs-build
http://www.haikuware.com/directory/view-details/drivers/audio/ad1816-driver
http://www.haikuware.com/directory/view-details/drivers/audio/cmi8330-isa-driver

I think this use of the Haiku logo (http://haikuware.com/images/stories/beoslogo.png) goes beyond fair use and is detrimental for Haiku in several ways.

First, it is misleading, as it is widely used for drivers that are BeOS or ZETA only and/or obsolete, with the potential to cause users problems that would not occur otherwise. These problems permeating to bug reporting (as seen in the above-linked Trac entry) is also a nuisance for the developers.

The logo also gives the impression that the software has been somehow certified or tested to work with Haiku, when that's not the case. Even under the current trademark policy...

http://www.haiku-os.org/about/trademark_policy

...this use by Haikuware clearly falls under the unacceptable use as "Official endorsements, expressed or implied, of third party products, services, or organizations *without* prior consent of Haiku, Inc."

Last bu not least, this derivative of the "Haiku Compatible" logo where the shape has been changed and the logo then combined with somebody else's trademark is (to say the least) very problematic from a branding POV.

Any thoughts?
