You're assuming the code is done as a port of the linux ext2 module
and not written from scratch. Ours is not derived from the linux code
at all, it was written directly by Axel. As such there is no GPL issue
here.

Actually, even if you used gpled code, that would not really be a problem for us, as the MIT licence doesn't prevent us from including GPL code. It would be a problem if someone wanted to build a proprietary or otherwise non-gpl-compatible flavour of haiku, in this case this person would have to remove the gpl code and either rewrite it or lose a feature.
