Same for OpenSuSE, however, I would assume that the companies behind those distributions actually have the rights to do so (unlike us).

In fact i went a bit too fast, after some googling, at least it's still a mess for bcm43xx cf: https://help.ubuntu.com/community/WifiDocs/Driver/bcm43xx With regard to possible company agreements, i think that most of the times the licence actually allows this use. By my interpretation of the intel 3945 firmware licence, it just says that the licence has to be on the same media... so we should be fine with that one (and other intel's probably) at least.
