I contacted Olivier Durant who hosts SyncModular's website, inquiring
about a contact to SyncModular's original author. He had an old email
address which was still active! Below is Vadim Zavalishin's response,
including my mail for context.
So, what is the right approach? Just repackage or try the official way
by asking Native Instruments and risk a refusal...?

I'm surprised and pleased that this 15 years old piece of software is still
in use.
Regarding the repackaging of the software and making a new icon, personally
I have no objections. However, the deal about making SynC Modular free also
involved the negotiations with NI (Native Instruments), therefore a permission
from NI would be necessary as well. Personally I guess NI wouldn't mind
either,
however I can't really speak for NI in this regard. On the other hand, asking
the NI's legal department would blow this minor thing completely out of
proportion.
Maybe you could argue that simply repackaging a zip file in a different format
doesn't constitute a modification of the software anyway.
As for making SynC Modular open source, I guess at the time the answer is
"no".

First off, thanks for SyncModular! It's a fantastic piece of software
and one of my most favourite applications under Haiku, where it still
runs nicely due to it's binary compatibility with BeOS.
Contrary to BeOS, Haiku has a package management system with a central
application to search, install and uninstall software: HaikuDepot. It
would be nice to find SyncModular there. Packages are usually built
with the help of a sort of script, so called recipes. There already is
such a recipe for SM [1], but its licence item 9 seems to prevent us
making the package available:
"9. REDISTRIBUTION. You may further distribute the evaluation
version of the software, provided you distribute it in the original
unmodified form. You may take money for the distribution of the
evaluation version to cover the media costs and other expenses arising
in the process of the distribution."
Is it possible to get your approval for distribution?
Haiku uses vector icons. Would you approve us providing one vaguely
similar to the original?
Aside from distibuting the binary, is there any chance for SM to
become open source? Just asking, because chances are Haiku won't stay
BeOS binary compatible forever. Also some minor drawing issues could
be fixable.
I understand if open-sourcing isn't possible, just thought I ask...
