(A propos du droit d’ingérence humanitaire et du droit international !)
Je vais m’absenter une douzaine de jours en concert du 29 août au
11septembre :Avant mon départ j’ai constaté que ma contribution avec le
titre ci-dessus n’a suscitée aucune réaction ou commentaire
C’est vrai voir le fonctionnement actuel des Institutions internationales
basé sur les Etats nation et avec l ’impuissance actuelle du Conseil de
sécurité de l’ONU sur certains dossiers compte tenu du droit de véto
accordé à chacun des membres permanents je suis conscient que mon propos est
présentement- utopique, irréaliste, déplacé, et non applicable
Cependant, je ne peux pas envisager que des personnes et organismes qui
réfléchissent sur la paix et l’harmonie, qui élaborent des documents des
dizaine de pages sur le sujet, ne s’interrogent pas !
Oui ou non :le respect du droit au respect de la dignité de la vie est –il
une valeur fondamentale ? N’y a-t-il pas une contradiction avec l’état
actuel du droit international ?
Comme je l’ai écrit : » Si la politique ne le propose pas, c’est à

Signalons, que la charte des Nations Unies présupposait l’existence d’une
communauté mondiale. Cependant la charte contient deux principes
contradictoires. D’après l’un des concepts, les éléments constitutifs sont
les Etats, l’autre est axé sur l’être humain en tant qu’individu. Or, dans
la structure de l’organisation des Nations Unies le premier concept
prédomine et s’illustre par des procédures évidentes.la tâche de
l’organisation d’imposer des limitations et des contraintes aux Etats
s’avère compliquée dans la mesure où les Etats sont maîtres de leurs
décisions. Les Etats répugnent à se fixer eux-mêmes leurs propres exigences
dans le respect des devoirs.
Tout aussi inquiétant : Comme l’a mentionné un juriste :Frédéric SUDRE, dans
un essai de plus de 800 pages consacré au droit européen et international
des droits humains, actuellement le droit international a été incapable de
donner une définition précise du concept de peuple. Quant au droit à la vie
= il reste incertain, ceci, car si les textes internationaux énoncent le
droit à la vie, ils ne définissent pas la vie !
Pour ma part, j’ai donné ma définition de ces 2 exigences dans mon ouvrage.

Certes le rôle du philosophe même incompris ou minoritaire est de proposer,
faire réfléchir sur le sens et la totalité de la citoyenneté individuelle à
mondiale
La philosophie a une fonction critique qui lui est essentielle, elle est
faite pur fonctionner ; même si ce que je dis ne verra le jour que dans 10,
20,50 ans ou plus, l’essentiel pour moi est l’action :celle de l’esprit et
du cœur !

I will go away a dozen days in concert from August 29th to September
11th:Before my departure I noted that my contribution with the title above
did not cause any reaction or comment
It is true to see the current operation of the International institutions
based on the States nation and with the current impotence of the Security
Council of UNO on certain files taking into account the right to veto
granted to each permanent member I am conscious that my matter at present
utopian, unrealistic, is moved, and nonapplicable
However, I can not to consider only people and organizations which reflects
on peace and the harmony, which prepare documents of ten pages on the
subject, are not questioned!
Yes or not:the respect of the right to the respect of dignity of the life is
a fundamental value;Isn't there a contradiction with the actual position of
the international law?
As I wrote: ” If the policy does not propose it, it is to the writer with
philosophical purpose to propose it.
Let Us Announce, that the United Nations Charter presupposed the existence
of a world community. However the charter contains two contradictory
principles. According to one of the concepts, the components are the States,
the other is centered on the human being as an individual. However, in the
structure of the United Nations the first concept prevails and is
illustrated by procedures évidentes.la task of the organization to impose
limitations and constraints in the States proves to be complicated insofar
as the States are Masters of their decisions. The States feel reluctant to
set themselves their own requirements in the respect of the duties.
Quite as worrying: As mentioned it a lawyer:Frederic SUDRE, in a test of
more than 800 pages devoted to the European and international right of the
human rights, currently the international law was unable to give a precise
definition of the concept of people. As for the right to the life = there
remains dubious, this, because if the international texts state the right to
the life, they do not define the life!

Admittedly the role of the even misunderstood or minority philosopher is to
propose, make think on the direction and the totality of the individual
citizenship of world
Philosophy has a critical function which is essential for him, it is made
pure function; even if what I say comes out only in 10,20,50 years or more,
essence for me is the action:that of the spirit and the heart!
