The EXTERNAL part of the window frame (the trim) is the HOA responsibility.
The MOVING part of the window frame and the window assembly as a whole
is the homeowner's responsibility.
Examples:
- The HOA paints and fixes the exterior trim of the original wood windows.
That's it.
- It's the homeowner's responsibility to kee the moving parts of the
window (the sash) and the overall window assembly maintained and
painted.
- If the homeowner does not replace a window that is falling apart
and leaks, thereby causing harm to to fascia or other external
trim, that then is the homeowner's cost to repair. At that point
we'd likely start the window replacement clock on that unit.
I talked to Tom and here is what is going on:
- 811 wants to sell soon but wants their window trim painted first.
That's not happening. The buyer just needs to know that
this trim will be painted in our next painting cycle. UNLESS ...
- If 811 is on a window replacement notice and that clock is running,
we'll paint whatever we can but .. the buyer inherits that obligation
to replace the window by the original date. If this is the case,
this has to be disclosed to the buyer as a liability of the sale.
I cannot recall if 811 is on the window replacement list. Sandy, do you
(or anyone else) have the current list.

Sandy and I walked the property a year or so ago to identify the units
that needed new windows, and where. You said you sent notification letters
to the relevant homeowners. Surely you have copies of all that?
