Thanks for the picture; it is very helpful. However, I do not see a parapet
wall in the classic sense of the term (a wall surrounding a roof). I only see
a party wall that extends above the roof line. Party walls are frequently
required to be fire walls as well, and do extend above the roof line. That
portion of the party wall above the roof would be characterized as a fire wall
parapet; however, it is still part of the party wall.
Maintenance, repair, and replacement of the party wall, whether above or below
the roof, would be governed by the Party Wall Provisions of the Declaration.
The Declaration states In the absence of damage caused by the negligence of an
owner: "The cost of reasonable maintenance, repair or replacement of said party
walls shall be borne equally by the Owners of the Lots served thereby, and
easements for the benefit of such uses among the Owners are hereby granted
therefor."

party wall. We have now approved a proposal for about $7000 in tuckpointing
work to be done on the parapet wall, above the roof line, but the extension to
the party wall between 812 and 814. The question came up at the Board meeting
last week as to whose expense this should be. Per the Dec, party wall repairs
are shared by the two connected parties. The roof and tuckpointing, however is
the Association. What do you think this comes under? Thanks
