I fully agree eclipse should be fine with this. But point is... they say
they are not. I think it is bad for them and bad for us. But hey bankers
and lawyers are the rulers of today's world.

I think there are 3 options:

1) become a real eclipse project (and hope then we get an exception)

2) Change the logo till they accept

3) Wait for eclipse to sew (which they probably will not do)

The first one is an absolute no go for me. I would expect this type of
issues just to become more often and more frustrating.

The last one has the disadvantage that you are fighting against someone
you need.

It reminds me of the balancing act between employer and employee.
Something I've proven not to be good at. After 3 years I'm only slightly
recovering of a burnout.

Currently I would go for option 2.

As I already suggested I think following options may give quick and easy
results and result in another answer of eclipse. If not I'll reconsider
option 3.

moving the center of the orange circle (up down left right)?
Changing the diameter of the orange circle?

Excuse me my poor graphical skills but I mean something like this

Hi,

We need to redo the logo. Eclipse will not approve the crescent which I
thought they would.

Specifically it is the part where the "moon" overlaps the sun and
leaves that crescent.
