We understand David's concern that an extended licence might be wrong for our
neighbourhood under some future ownership of the Brocco.
However we don't feel too concerned for the following reason.
The opening times of the Brocco are controlled by two documents: their Licence
and their Planning Permission. The most restrictive times take precedence.
So if a future owner was to abuse the situation then we could stop them by
getting planning enforcement.
We have also found from experience that getting a tight restriction in a
License is difficult.

Dear ECCO
Brocco on the Park has requested two changes in their licence. Tiina Carr has
emailed ECCO and has worked to keep good relationships with neighbours I think.
However, if Brocco were to change hands I understand the the new owners could
apply for the same license. Any representations must be made in writing by 28th
March. Address is listed below.
The application is for:
- an extension in licensed hours
- to use an area outside for sale of alcohol. A picture of the plan is attached
'It is sought to licence a small area so as to facilitate sales of alcohol
externally particularly in connection with events and private bookings. It is
not anticipated that the external area will be used on a daily or regular basis
and in any event will be restricted until 21:00 hours as per the condition.

To permit licensable activities Sun – Thurs until 23:00, Fri & Sat until

My view is that the application seeks to extend licensed hours too late into
the evening for a residential area. Restaurant operation does not require such
a late license in my view.
The external area license conditions will not preclude the outside area being
used to sell alcohol on any night. Once a precedent has been set any new
owners could apply for the same licence and then use the new times and outside
area any number of nights they see fit. My view is also that the outside sales
may change the purpose of that area and is not appropriate for what is a
residential aeea. The area at the moment is used as an outside eating area
where people sit and eat and drink. An outside bar with sales could mean it
may become a predominantly drinking area which is not appropriate so close to
houses.
I will write to licensing with my views.
