Ah okay, that's pretty interesting. So if you record a tournament of a 
particular game (KI as an example) you aren't allowed to sell the tournament 
footage at all? I wonder if that disclaimer is made explicit when one buys a

Not quite the same but on a similar note I recently read an article about 
Microsoft possibly enforcing additional controls over their games and not 
allowing third parties to directly generate income from them. I think guys were 
saying that it may become
 illegal for tournament organizers to generate income by streaming or using 
their games to do so unless they'd obtained permission from Microsoft itself. 
Personally I don't see it happening any time soon - if at all -  but who knows, 
laws around these sorts
 of things always seem fuzzy and the streaming industry is becoming pretty 
massive with ludicrous sums of prize money being thrown around so maybe?
