Perhaps the author wasn't as diligent with legal/copyright issues as we are 
being?

We have the luxury (or sometimes curse? :-P) of having many viewpoints from 
many backgrounds and areas of expertise, including legal aspects and how they 
apply to our endeavour. Perhaps VeraCrypt's author, Mounir Idrassi, was less 
knowledgeable and/or diligent about such legal aspects?

It is licensed under the Microsoft Public License (Ms-PL)

But...

VeraCrypt is a free disk encryption software brought to you by IDRIX
(http://www.idrix.fr) and that is based on TrueCrypt, freely available at
http://www.truecrypt.org/.

So how did they change the license? Clean room development? Grant from the
authors?

But they also say:

VeraCrypt storage format is INCOMPATIBLE with TrueCrypt storage format.

And then in the source it has TrueCrypt License Version 3.0
