If the book has an U.S. copyright there's nothing to prevent the Library Of 
Congress from recording the book if they wish to.  Additionally, if the 
book is marketed and sold in the U.S. there is nothing precluding Bookshare 
from adding it to its library.  There are other exceptions providing for 
including books in either the L.O.C. or services like Bookshare, but it 
would seem a bit pointless to go over them without more information about 
the book in question.
