FYI – I tried to speak to HQ’s legal services, but was asked to put everything
down in an e-mail. That is below. I’ve not heard anything from them other
than an automated reply giving lots of information about SATC and Legal Service.
Talking with a friend who has a septic tank on someone else’s’ land he has an
“easement” in his deeds which permits him to discharge waste from the septic
tank onto his neighbours field. There are conditions in the easement that
means he is responsible for ensuring the discharge is not causing any problems
and for any repairs or remediation to the field caused by the discharge. The
documentation was drawn up for a previous occupant and the farmer by solicitors
and is held as part of the deeds to his and his neighbour’s property.

Dear Sirs
May I ask some advise and guidance from yourselves please concerning the
Blackhills Scout Campsite in Bradford West Yorkshire. You hold the deeds of
land we own around that campsite.
We have been approached by one of our neighbours who wishes to put in a septic
tank to his property. He currently share a tank with a neighbour, but
circumstances are such that it is difficult for him to maintain this
arrangement.
The position of the tank would be in the corner of one of the fields owned by
us. This field is presently farmed under an agricultural tenancy with a local
farmer as grassland/meadows. The farmer has verbally said his has no
objections to the siting of a tank.
The householder is exploring with the local planning authority (City of
Bradford Metropolitan District Council) the proposal, but obviously needs
permission from us to proceed.
The location is remote from the present campsite by about 1/4mile, but does
border a public highway (Lee Lane) and a public footpath runs alongside the
wall on the opposite side of the field.
Could you advise what we should be asking and what liabilities such a device
may impose on the site? We would like to generate a minimal amount of rent
from the use of the field if possible.
