I was the only one who defide their order to not go beyond the Austin Blair statue.

As if I could see it!

Bottom line is they were protecting the Lt. Governor from words.

I understand that you had a constitutional right to demonstrate. What I'm
trying to understand is what they were objecting to. What were the barriers
put up to protect. Was their sole objection that you were distributing
pamphlets? Why did they choose only you to arrest, rather than the whole
group?

That is the opropoganda. For in fact this was not a reserved event, but
rather an event that was free and open to the public on state capitol
grounds. And in fact I personally was on the planning committee!

All of that is a part of the public record.

What I and others were "protesting" is the very fact the ADA is violated
daily here in Michigan and, indeed it was literallty violated again on
September 17 when barriers were literally erectected to us participating and
what was our "crime"? We had leaflets?

I do not obey unlawful orders and that is the differance between civil
disobedience I guess.

Maybe not.

Regardless the order wasn't lawful in the least, and People v. Marano shows
I do not have to obey an unlawful order.

By the way the most public of fora is the State Capitol lawn.

If we are not allowed freedom of expression there then we have it nowhere.

We might just as well stop pretending that we are a democracy.

I thought, from the material that you sent me privately before you were
back
on the list, that your group did, in fact, engage in civil disobedience
by
protesting in an area that had been closed off to demonstrations. Am I
confused? I also thought, from what I read and could hear on the video,
that you, specifically, had moved beyond where the barriers were set up,
either on purpose or accidentally, and that was why you were arrested. If
that is the case, then you were arrested for civil disobedience which
involved actions as well as speech. In other words, they wanted no
protests
at the ceremony and by staging a protest, you were engaging in civil
disobedience.

As I writhere the powers that be have offorred me in transcripts not yet

this minuted revealed to anyone let alone me the fact that they denote

I didn't take that then and won't take iyt now.
I'm not guiltly of anything except opposing the state with words.

If that is a crime then we are all criminals.

If we are all criminals for speeach. Then we are all doomed.

I have been deemed "guilty" for civil disobediance before.

But in this case I will never plead guilty as this wasn't even an act of
civil disobedience.

I had every right to attend this open and public event!

Yes, I dig. I thought that those charges against you would be
quickly dropped within a few weeks after the protest.

Joe, I will be thinking of you often as this mess continues. IMHO,
you are a true hero for risking arrest and fighting injustice. IF we are
ever to become a civilized nation, we will need lots more like you. Keep
fighting the good fight!
