Incorrect comparison, in the case of Zicotti park the agreement between the
owners and the city would that the park would be open to the public. In the
case of the pipline the land was awarded to the company as you noted, by
imminent domain. Although I don't agree with that it does exist in the law and
as the law currently stands imminent domain is legal and that does make it
private property of the company. Recently I posted about what Spectre energy is
doing in my neighborhood for their own pipeline (taking homes by imminent
domain). I don't agree with it but I do acknowledge it.

Private property? The land belonged to the tribe. The company got the land
through eminent domain. The tribe petitioned the court, saying that proper
procedures hadn't been followed so the company should pause in its plan to
start working. Large numbers of Native Americans gathered to protest on
Ssaturday when the company proceeded to start digging. So yes, from the point
of view of the company, they were all tresspassing and any journalists who were
there to cover the event were tresspassing. But that's only true if you don't
recognize that the land belongs to the tribe and that you side with the
company. Did you also think that Occupy was tresspassing in Zicotti Park? It
was a park on private property. That's what Wall Street and mayer Bloomberg
thought. It kind of depends on which side you're on.

If she didn't "cross any line" then why is she charged with trespassing?
Neither you nor I can determine if she was on private property or not. So
please don't lecture me on facts that you, yourself cannot prove. The fact that
she was trying to interview a guard initself suggests that she may have been
trespassing as a guard would not have been guarding public property but
guarding the company's right of way. Yes, journalists have tofollow laws too.

You can look at the Democracy Now website and see the video report that was
done on that Saturday when the security guards loosed the dogs on the
demonstrators. Amy Goodman was there with her staff as a journalist,
interviewing people, including attempting to question one of the guards who had
just set a dog on someone. She did not cross any line. You need to check factss
before making allegations.

I have to pause when I hear about journalists crossing the line from reporting
the news to making the news. Sort of reminds me of some of the actions of right
wing journalists "covering" Furgerson.

An arrest warrant has been issued in North Dakota for Democracy Now! host and
executive producer Amy Goodman. Goodman was charged with criminal trespassing,
a misdemeanor offense. A team from Democracy Now! was in North Dakota last week
to cover the Native American-led protests against the Dakota Access pipeline.
On Sept. 3, Democracy Now! filmed security guards working for the Dakota Access
pipeline company using dogs and pepper spray to attack protesters.
Democracy Now!'s report went viral online and was rebroadcast on many outlets,
including CBS, NBC, NPR, CNN, MSNBC and Huffington Post.
"This is an unacceptable violation of freedom of the press," said Amy Goodman
in a statement. "I was doing my job by covering pipeline guards unleashing dogs
and pepper spray on Native American protesters."
