The above is for contract reference. Now, I point your attention to the
following:
“The Contractor shall also comply with the provisions of:
The Americans with Disabilities Act of 1990, 42 USC 12101 et seq.
The Michigan Persons with Disabilities Civil Rights Act, MCL 37.1101 et seq.
Section 504 of the Federal Rehabilitation Act of 1973, 29 USC 791 et seq.,
which states that no employee or client or otherwise qualified handicapped
individual
shall, solely by reason of this handicap, be excluded from participation, be
denied the benefits of, or be subjected to discrimination under any program
or activity receiving federal financial assistance.
HIPM regulations at 42 CFR Part 160 and Part 164.
4. Freedom of Information Act
All information in this Agreement is subject to the provisions of the Freedom
of Information Act 1976 Public Act 442, as amended, MCL 15.231, et seq.”
I have sent you and your office numerous instances of basic and core violations
of the ADA and Section 504 over years and to the present. The short list is:
-TDN in documented fashion has held numerous events including ADA celebrations
themselves that are not ADA compliant both physically and in regards to
effective communications. In fact at this years celebration there was plenty of
print information but not one single item in any alternate format.
-TDN and Zelley retaliate against folks like me who point out ADA and 504
violations.
-They do not allow PWD even in to their board meetings which violates the very
non-discrimination provisions of 504 referenced above.
-They refuse to remit or even respond to requests for accessible information to
people who are blind and/or do not remit it in anything close to a timely
manner.
-They do not have all materials used for consumers readily available in
Braille, audio, large print, and electronic forms affirmatively and lie in 704
reports when they say that they do.
-Their own web site and elements therein are not fully compliant with these and
other civil rights laws.
-Again they often have not even responded to requests for accommodations which
is a violation in and of itself.
-Though TDN and indeed I along with TDN have conducted numerous ADA
accessibility surveys in most cases identified barriers have never been removed
and moreover, TDN has refused to remit to me even recently accessible copies of
those surveys, even related to my own polling place. Some advocacy huh?
Again this is but a very short list.
Time for an in-depth and comprehensive monitoring of this scofflaw entity!
Please remit to me what you all are going to do about this renegade and serial
ADA/504 violator of my and others fundamental civil rights.
