not sure anything the Republicans would do would result in any significant loss
of credibility among their faithful…remember Trump’s claim that he could walk
down Fifth Avenue and shoot somebody, and he would not be in any danger of
losing support? Scary, isn’t it, but probably true…
There is an internet meme out there showing Obama that reads something like, go
ahead, block any nominee to SCOTUS…then, when either Hilary or Bernie is
elected, he/she can appoint me to be on the court…

court. Or, he could nominate the black guy who is a circuit court judge and
already confirmed once for that position. If the Republicans blocked him,
they’d have to pay for it on Election Day. Or, he could appoint a liberal as

As expected, Biden is hoping that Obama will pick a relatively noderate
replacement for Scalia. While, in my heart I would disagree with Biden here I
do believe that what he says makes a great deal of sense.
IF Biden were to pick a flaming liberal, it would be much easier for the
senate to block the nominee and possibly not even hold a vote. And, if a vote
were held, the nominee would surely be defeated.
If, however, Obama follows Biden’s advice, then the republicans will risk
losing the Senate in November if they do not confirm a moderate nominee,
especially someone they approved unanimously 3 short years ago. I do not see
this as settling for the lesser of evils as happens often on election day. I
see this as a way of backing Republicans into a corner while filling the
vacancy in the Supreme Court.
To me, the positives of nominating a moderate far outweigh the negatives. It
is likely that a moderate nominee that Obama might pick would be pro-choice
and would stick up for the disenfranchised. Unless we’re damned sure that a
Republican will not be elected in November, I’d say that Obama would be
unwise to ignore Biden’s advice.

It's possible that this is just a trial balloon -- Biden saying this to a
reporter to gauge how the public, and especially progressives, would react.
But that makes it even more important for us weigh in now and tell the White
House to choose a progressive nominee.
The tremendous amount of grassroots energy focused on ensuring the Republican
Senate votes on President's Supreme Court nominee will dissipate dramatically
if he puts forward a candidate who isn't rock solid in their commitment to
major progressive priorities for the court like protecting abortion rights
and overturning Citizens United.
Defeating Republican opposition to any nominee the President puts forward is
going to be incredibly difficult, but it becomes much, much harder to ramp up
pressure on the Senate if the grassroots activists the White House will need
are uncertain of how committed that nominee is to core progressive values.
You've already joined more than 100,000 DFA members to sign the petition
urging President Obama to pick a progressive. Now can you build momentum and
share the petition with your friends on Facebook?
At this point in the process, it seems unlikely Republicans will vote to
confirm anyone the President nominates, even if Republicans might now be
willing to give that nominee a hearing. Instead, what President Obama should
do is pick a nominee who shares America's progressive values. That's what two
leading legal observers, David Fontana and Ian Bassin, wrote in Slate on
Wednesday:
"Obama should nominate a justice who will serve as a compelling messenger for
the vision of his administration long after he leaves the stage. In other
words, Obama should pick a 'Liberal Scalia' -- an immensely qualified,
rigorous intellect, who also can serve as a leading proponent of the judicial
philosophy President Obama has articulated and that the country has ratified
by electing him."
The 100,000+ DFA members who signed the petition urging President Obama to
pick a progressive want someone who will follow in the footsteps of great
Supreme Court justices like Earl Warren, Thurgood Marshall, William Brennan,
Ruth Bader Ginsburg -- and others who used the power of the Supreme Court to
advance the cause of justice and equality.
The movement is growing: Today, our friends at CREDO are also asking their
members to urge President Obama to pick a progressive.
With several extremely important issues pending before the Supreme Court,
including cases on abortion rights, voting rights, climate change, the future
of labor unions -- as well as our overarching goal of repealing Citizens
United and similar decisions -- we need to make sure that President Obama's
nominee will rule the right way. We need a progressive champion, not an
unreliable moderate.
This nomination could determine who controls the Supreme Court for a
generation or more. You've already signed the petition. Now will you share
the petition on Facebook? Ask your friends to urge President Obama to
nominate someone who will uphold America's progressive values.
