That's right, my point was that I think Noel and you were making two =
different arguments. The entity submitting the books, regardless of how =
they are submitted, verifies by signing the volunteer agreement =
(embodied in the member agreement) that they did not violate copyright =
law in obtaining the book. There are shades of grey in terms of who =
actually scanned the book of course. Someone physically incapable of =
operating a scanner who has assistance, or a student who has a book =
scanned for them by a DSS provider, are generally considered to be on =
the right side of the law (fair use, in most cases), so their =
verification that they have not violated copyright law would hold water. =
But the case where someone else scans books, and another person =
downloads them from the internet/get them emailed to them, that would be =
a copyright violation, and that person would be breaking their terms of =
membership by submitting those books.

Basically, the thing to remember is, you are individually responsible =
for not violating copyright law in order to obtain books. If you do so, =
you should not submit them to Bookshare.org, because submitting them =
would vioate the terms of of your membership/volunteer agreement.

Jesse, it is my understanding that volunteers, disabled or able-bodied =

-- can submit any number of books either through the system, or on CD.=20
However, those must be books that have been scanned and recognized by =
the=20
volunteer in question, and not received from a third party or from=20
another repository.
If this rule has recently been relaxed, I would in fact be delighted, =
and=20
would like to know the details.

Elizabeth:

You may certainly send us hard copy books, but we have a few caveats, =
=3D
and they're pretty big ones!

1. We can't pay for shipping for donations.
2. The books will be processed when we get to them -- our in-house =3D
scanning operation is relatively small, and despite our fast scanner, we =
=3D
always have a lot more books than we have time! The books will be =3D
prioritized based on needs in the collection.
3. The books won't be returned (they'll be despined)
4. The submitter will not be credited for the submissions (though he or =
=3D
she can claim them as a tax deductible donation)
5. If you're talking about more than 50 books or so, please right me =3D
offline so I can make sure that we can accomodate them.

Sarah/Guido/Noel: It's certainly fine for registered volunteers to =3D
submit books on CD for processing by Bookshare.org staff/other =3D
volunteers. Many have done so when they have large quantities. I think =
=3D
there must be some misunderstanding between you three, because I believe =
=3D
Guido did so before we launched, so I'm sure he knows and understand =3D
that it's allowed!

jesse.
