Yes, there is a way to prove that a book comes from Bookshare. Bookshare
modifies each book before downloading it in order to be able to identify who
downloads it. According to the language in the notice at the top of each
book, each book contains digital watermarks and fingerprints to identify who
downloads that copy of the book. A pirated book can be checked for these
watermarks and fingerprints to determine who is pirating the book. Since
Bookshare adds the watermarks and fingerprints to their books, a submission
to another site would be identical to the same submission to Bookshare, but
the downloaded books would be different.

specifically downloaded by you. It is illegal to delete or modify these
watermarks and fingerprints under the terms of the Digital Millennium
Copyright Act. Bookshare.org
has an active monitoring system in place to protect against this, which
includes maintaining records of the identity of the persons downloading
books and materials from the Web Site. We do so to protect this valuable
exception in the copyright law that permits the Bookshare.org and similar
services. Your
Member Agreement expressly authorizes us to include these security devices,
solely for this use, as an express exception to current and future privacy
laws relating to protection of personal information data.

I don't think you're misinterpreting. Jim was pretty clear that we can't
submit our scans that we send to bookshare anywhere that is illegal.
However, my understanding is that it wasn't for ownership reasons, but
rather so that anyone checking illegal services out won't find an exact copy
of a book that is on bookshare. The problem is that there is no way to prove
that the book on the illegal site wasn't gotten from bookshare itself, if
the files are identical.
I don't like it either, for the same reasons discussed here. I'm just
clarifying, and like it or not, I do understand it.

probably are very unaware of what Bookshare's plans for the future are.
Without being aware, it really can come across that nothing is being done.
Many of those comments come to me from people who buy products that have
Bookshare access bundled but find that they aren't eligible because they
live in the wrong country. These people become naturally very resentful. I
would, too: here was my hope built up of being able to access titles, and
it's dashed to bits all because I live in the wrong country. I can
understand the sentiment quite easily.
I can also understand the confusion over what constitutes a "Bookshare book"
and the issues surrounding limiting what people do with their scans. If
another legitimate service popped up somewhere, would we be prevented from
submitting our scans there? I have to admit that I'm a bit unsettled at this
point by some of the implications of what I'm reading here. There seems to
be an ownership of our scans implied beyond the issue of pirate sites. I am
troubled by this concept. I can understand the concept of protecting a book
that is Bookshare-downloaded in the same way that you wouldn't want a
submission that comes from NLS. I do have a problem with the concept that we
could not take the original scan and submit it, and I would appreciate
having that clarified as well. Perhaps I am misreading because I have a
tendency to interpret things too literally. I hope so.
