if memory serves the USAG has no say in this.  The convening authority (    CG 
Ft Hood) determines the seeking of the death penalty with the Secretary of the 
Army concurring, POTUS signs the death warrant at the proper time.


Of course with Barack bin Obama you'll never know what kind of pressure he'll 
exert on the SecArmy and SecDef.
