This has all been very interesting. I have always considered a situation like
this to be ‘related’ or ‘separate’ work versus ‘derivative’. Especially where
you say someone has to download one bit and this is just automating calls to
it. There was no modification to Argyll other than now you get a nice little
GUI to execute the operations. Perhaps if Vladimir wanted to charge for it, I
could see a bit of an issue. And similarly the inclusion of the binaries
muddied the water… I actually didn’t even realize that they were in that
installer since it was asking for the path to them and figured I had to
download them separately all along.

Subject: [argyllcms] Re: New GUI for Argyll
Vladimir,
Many people have written GUI wrappers for Argyll at some point, including me,
for private and public use, (mine was in private use only) and AFAIK there
have never been issues precisely because the mechanism for GPL software is
widely understood. I'm sure there is no problem here or rather there will be no
problem here once you conform precisely to the letter of the AGPL, which Graeme
has chosen as a license.
Also, be aware that Argyll gets updated quite frequently, and it is useful
that the user be able to swap the software for a patched version easily without
reloading the GUI from you.
There is a history of issues concerning color management software licensing,
including some firms which limited distribution of generated profiles.

Hello Guys,
by announcing my [color]profiler, I really was not aware that it will produce
such a *storm... My idea was to produce something useful for us all, similar to
Florian's Dispcal. Something that has to be maintained and kept up-to-date
bringing benefits to us all -and lest but not last, to Graeme since I clearly
announced, that 50 % of each donation will be forwarded to Argyll. In addition,
it's my task to maintain and develop this application keeping it fresh &
healthy. The reason I decided to distribute Argyll alongside with the
executable file lies on hand and is entirely end-user-oriented.
I agree totally, that Argyll is entirely Graeme's work and the efforts he put
in maintaining this software, keeping this mailing list alive etc is really
amazing. On the other hand, I'm using this software for more than 10 years now
in all kinds of different ways. And there is far more than one way of using
Argyll. The GUI I wrote is therefore based on my very long experience (and
infinite working hours) and is entirely a product of my own knowledge that
incorporates all possible applications in graphic arts, photography & design,
textile industry, even multispectral imaging (which is my current line of
work), CGI etc.. So, even if this is my firstborn child, there is nothing to be
ashamed for. Really.
So, I don't want Graeme or anybody else to feel bad about this. On the
contrary, I want a solution that will make us all happy. The way I see it, it*s
up to Graeme to advise what is the best way to proceed. After thinking it over,
I don't have a problem to make this project entirely available under AGPL or
any other open source-license. This is one solution I already offered. The
other is, like Edmund suggested and Richard basically confirmed with one simple
sentence, to separate the executable files of the [color]profiler entirely from
Argyll. This solution would protect my source code, but I don't really feel
happy about it, since the poor end-user with no expert-experience in Argyll
will have more troubles getting the app to work properly. In that point, I
might say, that Graeme and me have reached an agreement. I mean, why write
software that is only for the "geek"? It's like a musician who spends his life
practicing without ever standing on a stage where people can hear him...
Regards
Vladimir.

I don't agree. The GUI would appear to depend for it's underlying color
management functions on ArgyllCMS, making it a derived work, irrespective
of who installs ArgyllCMS on the system.
