received your emails after such a long time withouthearing from you. About
your cases incourt, kindly notice that Judge Alex Kozinski was on the federal
bench for 35years, 32 of them on the Court of Appeals for the Ninth Circuit;
and was even thechief judge of that Court from November 2007 to December 2014.
For all thattime, he was known to sexually harass court clerks and externs.Yet,
he was protected by his peers and colleagues. But then The New York Times and
The New Yorker published on October 5and 10, 2017, respectively, their exposés
of Harvey Weinstein’s sexual abusefor over 30 years. Within a week the
MeToo!movement erupted worldwide. Supreme Court ChiefJustice John Roberts,
Jr., received around 700 letters from former andcurrent clerks and externs
complaining about sexual harassment by judges,including Judge Kozinski. Only to
avoid therisk of being swept by the MeToo! movementof intolerance of enablers
of sexual harassers did Chief Justice Roberts issuean order on or around
December 15, 2017, referring Judge Kozinski to the JudicialCouncil of the
Second Circuit for investigation. The Chief Justice realizedthat an
investigation by Judge Kozinski’s own peers and colleagues in the NinthCircuit
would have detracted from “confidence in the impartiality of theproceedings”;
in other words, it would have been suspected of being a whitewash resulting
from judges judging judges. Rather than face aninvestigation by the Second
Circuit, Judge Kozinski resigned barely three days later on December 18,2017,
with immediate effect. The investigation stopped. Judge Kozinski did nothave to
compensate any of his victims. Instead, he began collecting his fullpension
from the Federal Judiciary. Judge Maryanne TrumpBarry, the sister of President
Donald Trump, on February 11, 2019, resigned onFebruary 11, 2019, upon learning
10 days earlier that she was beinginvestigated for her participation in her
father’s distribution of his assetsto his children through a fraud scheme
involving shell companies to evadeinheritance tax. The investigation stopped.
She is simply collecting herpension. I have writtenabout this many times
before. But I suspect that you did not read my emails and,if you did, failed to
apply their information to your cases. In fact, allfederal chief circuit
judges dismiss100% of complaints filed against their peers and colleagues; and
deny100% of petitions to review those dismissals.This is a fact established by
the judges themselves in their officials statistics submitted to Congress in
the Annual Report of the Director of the Administrative Office of the U.S.
Courts.
Now judges have a protectorat the highest place: The attorney general
nominated by President Biden andconfirmed by the Senate is none other than
JudgeMerrick Garland, who was chief judge of the Court of Appeals for
theDistrict of Columbia Circuit until his seven-year term ended on February
11,2020. He dismissed 100% of complaints against his peers in the Court
andcolleagues in the District and participated in the denial of 100% of
reviewpetitions concerning the 478 complaints filed during 1oct06-30sep17
11-yearperiod. It follows that thejudges in your cases will be protected by
their peers and colleagues. AttorneyGeneral Judge Garland will not have the
Department of Justice investigate anyof them, for the investigation could get
out of control and investigate him tooand investigated judges could incriminate
him in exchange for leniency by the investigating authorities. The most that
canhappen is that your judges opt to resign and collect their pension. You will
beleft burdened with the enormous amount of effort, time, and expenses that you
lave already invested up to now.
Moreover, you will have to incur even more ifnew judges are appointed to your
cases and you decide to continue your battle. The new judges will doom it to
end up with the same result so that you and everybody else receive a message
that is painfully clear even now: "Don't you ever mess with us! We are Judges
Above the Law."
Those are thefacts.
Nevertheless, one Advocate wrote, “To avoid wasting time with you all trying to
"reinvent theWheel," I attach for your information and use my recent SCOTUS
filings”. As itis, the Supreme Court takes up only 1 out of 93 petitions for
review, i.e.,petitions for certiorari. It is certainly nota petition that asks
the justices to investigate, incriminate, and removefellow judges that will
persuade them to grant it. Therefore, you arein fact ‘wasting your time and
everybody else’s and reinventing the wheel’ whenyou expect judges to stop
covering for each other and themselves as they havedone in hundreds of
thousands of previous cases...or did you think that yourpetition is the first
one ever invented to roll into a court filing room or theone invented with the
most knowledge of the law and experience of courtprocedure? To think that
youwill cause judges to ‘throw fellow judges under the bus’ and order them
tocompensate you is a fantasy concocted by wishful thinking. That is the
antithesis of strategic thinking based on facts learned through law research
and reading.
Instead, you can dosomething that will make good use of your effort, time, and
money: Join us! Read the article below; Attend the Guardianship Abuse
Symposium; Promote the proposed unprecedented citizens hearings; and
Contribute to launching a MeToo!-like generalized media investigation of
judges’ abuse ofpower:
