Peter, I  think web site accessibility does come within the DDA.
Why do you think it doesn't?

I took action against AMEX in respect of their site in 2008, and reached an
out-of-Court settlement.

That site is totally unusable. Its a pity that website design doesn't come

Apologies for cross-posting, but I would welcome any thoughts on the
difficulties of using this website.

I have had great difficulty trying to bring up the relevant boxes for
choosing my departure and destination airports and when I wish to travel. 
Using the latest version of JAWS, I just couldn't access the choices.  I
even tried Accesstogo, something I have never used before, just to try to
get a different slant on things.  No go!

When I looked at the contact information, I saw that the number you could
call to book a flight, or speak with a Customer Services agent, cost 65p per
minute.  Naturally, I didn't entertain that.

This appears to me to be a classic case of an inaccessible website with very
little in the way of alternative assistance.  In the end, I had to ask a
sighted friend to book the flight for me last night, something that goes
against the grain! I got a couple of JAWS users to try the site for me to
see if it was something I had been doing wrong, but they both quickly
confirmed it is hopeless.  And Martin tried it using Voiceover on his Mac
too.  It told him that the information he was trying to reach was inside a
frame, but he still couldn't open up the boxes to make a selection.

I would be interested to know how alternative screen reader users among you
get on with this website.  I will be contacting BMIBaby about it.  In terms
of their assistance when I travelled with them recently for the first time,
they were excellent, and I encountered absolutely no problems, which is why
I am using them again over Easter.  It's just the booking of flights with
them that I am having difficulty with all the time.
