I agree it's silly.
Without being beholdent to the terms of some contract that
restricts listing a client, I see no reason for HSN's behavior
other than the fact that they might not want it to get around
that some small indie company did their site vs. the common
perception of some internal corporate entity. Sometimes size
implies poor quality and service, etc.
Anyway, this debate is interesting. Although I work for a
corporate entity now, I do take on freelance once-in-a-while and
always ask for permission (and add it as a clause in the
contract) to list a client if they're satisfied with my
execution.
However, having spent most of my professional new media career
working on projects for corporate entities, I have no qualms
about listing those projects (and clients) in my online
portfolio. As far as I can recall, I never signed anything that
legally prevents me from doing so and also I take great pains to
not mis-represent the project or my contributions to it.
Still, there's a dilemma. How does one promote their good and
services to prospective clients if past clients won't allow them
to reference past work?
