As to Maryland's & Virginia's legal battle over Fairfax County's proposal
to put a water diversion structure in the middle of the Potomac River, the
United States Supreme Court's 2003 decision merely ruled that Virginia had
the right under a 1785 compact between the two states to install the
facility -- the Court did not rule upon the boundary question, but it noted
that a 1877 determination had placed the boundary at the low-water mark of
the Virginia shore. If anyone wants to read the decision for himself, put
"Virgina v. Maryland, 540 U.S. 56" into any search engine.
