Hello Friends,
I wanted to thank those of you who have joined the "Justice for Annie" website.
I really appreciate it.

I noted that many of the key disability leaders in Canada have joined including
the Former Human Rights Commissioner of Ontario.
The two leaders of the American disability group, "Not Dead Yet" have both
joined also.
The David and Goliath show continues on June 1 when we are back in court. If we
lose (likely) it might costs us a huge amount of money but we had no choice. If
we go to Superior court we could lose over half a million dollars and if we
win, we would probably still be in the hole. In Canada, the life of a disabled
child is worth very little. We made the claim in Small Claims court because
even tho the maximum award is $10,000, the greatest loss is $3,000. To us, it
is a matter of principle and accountability.
The events that occurred were too egregious just to drop the complaint. In
Canada, the public/government pays for the majority of the doctors legal fees
so they never settle anything. They fight to the bitter end.
Somebody has to stand up to this system though. It doesn't matter who the
patient is, entering a Do Not Resuscitate without consent and "losing" the
medication report after withdrawing lethal quantities of narcotics cannot be
tolerated. To this day, we do not know how or why Annie died.
Even babies with trisomy 13/18 deserve a chance if it is in their best interest
(and parent's wishes) and a dignified death otherwise.
On May 25 (Annie's 4th birthday) we will be cross-examined on an affidavit by
the Hospital lawyers. The judge asked us to make an affidavit that says if we
lose the motion, we will not pursue the matter in superior court unless we can
find a probono lawyer. The Hospital lawyers had accused us of becoming self
represented just to gain the judge's favour and try to have our legal fees
paid.
On June 1 we will be back in Court and the judge will decide whether to let us
try the case in small claims court, or transfer it to Superior Court
with/without costs. This childrens's hospital is reputed to be one of the top
five in the world.
