Hello Trisomy Friends,
Yesterday was our big day in court. The two hour motion went on for six hours.
The Hospital is trying to move our case to Superior Court from Small Claims
Court.
In Canada, the value of a child's life with disabilities and a shortened life
span is worth almost nothing. The cost of litigation vastly exceeds potential
awards. Therefore, in a best case scenario, if you win the case, you would lose
$100,000. And if you lose the case, you would lose everything you own and more.
How is that for justice?
So despite the fact that there is damning evidence, including a Coroner's
condemnation, a medical review that says, "care reprehensible" no specific
cause of death, missing lethal doses of narcotics....the list goes on....it is
just too bad.
I want to emphasize that this is not a case of demand for futile care. We never
got to that point. Nobody has ever suggested that. This is all about a covert
withholding of care (the records are full of "diagnosis later....if symptoms
persist" and in the final 24 hours, a "slow code" resuscitation, a DNR without
consent and multiple violations in narcotic policies.
Oddly, and incredibly, we had an excellent relationship with Annie's doctors.
There was no need for this to occur.
So the issue is not that maybe Annie wouldn't be alive, so what does it matter,
it is an issue in policy and protocol. If we allow this treatment for tri kids,
who is next? They are the gatekeepers of eugenics.

Every human life deserves a chance, and if treatment/surgery is not in the best
interest, then they deserve a peaceful and dignified death. It is that simple.
