I don't interpret that statute the way Mr. Richardson does. I don't see the word "initially" in it. It clearly states "retain in his actual custody . . .". The sentence can stop there, the rest is a modifying adjective clause. I think the dumper can be charged with violation of this statute, if he can be found. It's at least worth the attempt.
