This will probably be unpopular but... I think Mr. Gwizdala jumped the gun by
writing his rant before speaking with Mr. Ober. Not that I expect that actually
speaking with the elected State Attorney would get him a better result. The
outcome in his case is actually quite understandable when you consider that
this is only a second degree misdemeanor, no one was hurt, there is a dispute
(whether founded or not) concerning important facts and an allegation of a
racial slur being used by the 'victim'. Jurors on misdemeanor cases are
frequently quite vexed that they couldn't get out of jury duty; I can't tell
you how many misdemeanor cases I tried where the jury would look at us as if to
ask 'why are we here?' Given limited resources, the difficult burden of proving
a case beyond and to the exclusion of every reasonable doubt and juror and
judicial indifference, the State must consider whether there is a reasonable
likelihood of conviction before bringing any criminal charge. I also think that
this is another example of an advocate doing themselves and their cause a
disservice by presenting their argument is such a shrill and strident manner.
