I guess(?) they figure the constant clamp current is low enough to not overheat their IC, and therefore they can call it 5V tolerant. Right. Then there are ICs without clamps that have a 5.5V instantaneous absolute maximum rating, and are therefore also "5V tolerant." I guess you can't deny that, even though it's not going to be interpreted that way.
