I have talked to the insurance agent. Before I answer the questions posed by
the members, I have what to me at least is a bomb shell. The policy listed
the club and it's board as the insured. The policy also contains an
endorsement for additional insured -Club members. Thus all members of SAC as
well as SAC itself are insured.
Now the bad news. Form CG 00 01 12 04 Coverage C Medical payments par 2-
Exclusions We will not pay expenses for "bodily injury":
a. ANY INSURED
to any insured except "volunteer workers".
It seems we need the waivers to protect ourselves from club members more
than outsiders.
Now to the Questions.
What are we insured against? - We have a commercial general liability
policy. This covers us for "At fault"
Limits Each Occurrence $1,000,000
Damage to premises rented to you limit any one premises $100,000
Medical expense limit (Any one person) $10,000
Personal and advertising injury limit $1,000,000
General Aggregate limit (Other than products- completed operations
$2,000,000
Products- completed operations Aggregate limit $2,000,000
Who is covered? SAC and its members are covered from guests and members of
other astronomy clubs.
When is the policy in effect? For the dates and times specified for an
event held by SAC. Travel is not covered, nor is a SAC member covered when
attending another organizations event.
How much monetary protection does the policy provide? - See above
What are the restrictions, conditions for coverage. The are exclusions for
Fungi and Bacteria, Liquor liability exclusion, Hostile fire (Flames not gun
fire) cap on losses from certified acts of terrorism, Electronic
distribution of unsolicited material (separately the WEB page and SAC lists
are excluded), nuclear energy liability exclusion and a pollution exclusion.
How are claims submitted? Notify the insurance carrier either verbally or
in writing.
What is the insurance company's stance on waivers? The individual I talked
to was left of center. It will do no harm and might, if properly
administered, do some good.
I will have the policy with me for tonight's board meeting and the general
meeting.
