Hi, Peter,
I agree that "we live in a litigious society.", and not wanting to be a
part of that "litigious society", I tend to stay away from those events
that require that I declare that I won't litigate "no matter what
happens", which makes no sense to me.
After all, A.J. Crayon could decide that he wants to take a dull knife
and carve me up at the next Messier Marathon, should I attend, for
whatever his reasons. If his actions are covered by the "hold harmless"
waiver, then I have no protection, and I certainly won't sign the
waiver, and won't attend. If on the other hand, if his actions are
excluded from the waiver, then what good is the waiver? Again, the
logic is the logic. Why have a waiver, and why should I sign it?
It's gotten to the point that I'll go off on my own, and not worry about
a club, or their events, not because I want to, but because it's a whole
lot simpler to do just that. That way I don't have to worry about legal
waivers, legalese mumbo-jumbo, but to just go out and enjoy the night
sky. Waivers are a roadblock to participating. I'll always choose to
go off on my own than participate in an event where a waiver is
required. It's just one more hurdle to attending a sanctioned /
sponsored event.
I truly understand your point of view, and that's your choice. I just
don't want to preclude any unanticipated events occuring that could
result in causing me, or my family, harm in one form or another. I
won't sign waivers, and I won't attend those events requiring them. We
each get the opportunity to make that choice (and I love choices), but I
decline to sign a waiver, or attend. That's SAC's choice to require
them, not mine.
