Then why have a waiver?  If events in the future will be as they were in 
the past, then no waiver is needed, right?  The logic is the locic.  If 
things in the future will be different than in the past, then maybe a 
waiver is needed, right?  I have no idea what that translates into, but 
I can assure you that I don't want to be around to experience it.  My 
choice.

Absolutely.  I choose not to sign away my rights, you choose to do the 
opposite. Those are our individual choices, and we both will have to 
live with the consequences, whatever they may turn out to be.  I too 
choose not to worry about those matters, hence I will not sign nor 
attend. My choice.  Pretty simple.
