After reading all this thread, the only safe action is: Buy lots of liability
insurance, stay in bed, and say nothing to anybody, because anything you say
can and will be used against you. I think we have become so paranoid that we
are going to make decisions we will regret in the future. If the officers and
board plan a star party on the rim of an erupting volcano and someone is killed
by lava, then we might be sued for gross negligence. On the other hand we have
a star party at 5 mile Meadow on a clear night and someone looking thru your
telescope has a heart attack and dies because he sees something that conflicts
with his religious beliefs. We are all responsible for what we say and do
regardless of where we are. It is in your best interest to have personal
liability insurance.
As for incorporation, there must be some good in it, all big and small
companies are incorporated. Granted some times you read about an officer being
sued for gross negligence, but it is usually for breaking the law.
Incorporation will protect officers unless they are personally responsible for
gross negligence. Insurance will protect the clubs assets.
I hope I have not offended anyone with my rambling thoughts.
