Well a few things come to mind here for me an again I am no lawyer, don't play
one on TV and didn't stay at a Holiday Inn Express last night either.
The whole issue of monopoly is one that is decided decades later in courts. It
has a number of very gray areas that can be argued longer than a senator in the
middle of a filibuster.
Discriminatory practices are more the issue here and the one that should be the
most upset is the other credit card companies. IF I take bank cards (and I do)
as a form of payment, then I don't get to pick and choose "which" bank. I take
them all or none assuming the card is valid.
Frankly ebay may have really finally opened the door for another major player
with this blunder.
