Saddam trial outside Iraq ruled out

IRAQI Prime Minister Ibrahim al-Jaafari has ruled out transferring Saddam 
Hussein's trial to another country.

He has rejecting calls from defence lawyers who mooted the move after the 
murder of one of them. 

"The process is a purely Iraqi affair, which should take place on the (Iraqi) 
territory and it is out of the question to transfer it anywhere else," Mr 
Jaafari told reporters after breaking the Ramadan fast yesterday. 

"The idea of such a transfer should not even enter our heads," he said. 

Mr Jaafari suggested that the murder of the lawyer of a co-defendant of Saddam 
Hussein could be aimed at getting the trial moved. 

     
     
       
      
     
     


They "wanted perhaps, through this act, to achieve this objective", he said. 

Iraqi police found the body of Saadoun Janabi, lawyer for Awad Hamad al-Bandar 
al-Sadun, after the lawyer's corpse was dumped in the impoverished northern 
Baghdad neighbourhood of Ur. 

Mr Janabi was kidnapped from his office yesterday by two carloads of gunmen 
wearing police and army uniforms, a tactic used throughout the country. 

The murder "has all the fingerprints of kidnappings and killings by terrorist 
groups", said Leith Kubba, a spokesman for Mr Jaafari. 

Saddam's Iraqi lawyer, Khalil al-Dulaimi, demanded better protection for 
Saddam's legal team. Government spokesman Leith Kubba said protection had 
already been offered. 

Mr Janabi's client, a former chief judge of the revolutionary court and deputy 
head of Saddam's office, sat next to the ousted leader in the dock when they 
went on trial on Thursday for crimes against humanity over the 1982 murder of 
almost 150 Shiites. 

A defiant Saddam and his former cohorts all pleaded not guilty to charges, 
including murder and torture, but face execution if convicted. 

The hearing was adjourned to November 28 but an ailing key witness is to 
testify at a special hearing within days. 

Mr Janabi's murder followed the release of Rory Carroll, a reporter from 
Britain's Guardian newspaper, who was kidnapped on Thursday after interviewing 
a victim of Saddam's regime. 

On the political front, electoral officials continued to count vote tallies 
from the October 15 constitutional referendum, after reports of anomalies in 
the voting. 

"We ask people not to rush us," electoral commission spokesman Farid Ayyar said 
yesterday. 

The charter that lays out the legal foundations for Iraq after decades of 
dictatorship can be approved by a simple majority, but rejected if two-thirds 
of voters say "no" in at least three of Iraq's 18 provinces. 

Although it is supported by Iraq's Shiite majority and the Kurdish community, 
the constitution is opposed by Sunni Arabs who fear its federalist provisions 
could lead to the break-up of the country. 

Arab League Secretary General Amr Mussa, in Baghdad on his first visit since 
the US-led invasion in April 2003, met with a leading Sunni Arab religious 
organisation in a quest to spur national dialogue and ease sectarian tensions. 

The Committee of Muslim Scholars set conditions for its participation, 
including a calendar for the withdrawal of foreign troops. 

Radical Shiite cleric Moqtada al-Sadr said he would take part if the League 
issued a written condemnation of violence against his community, attacks that 
are believed to be the work in part of Sunni Arab insurgents. 

Today Mr Mussa was to meet with Grand Ayatollah Ali al-Sistani, the revered 
senior Shiite cleric in Iraq. 

In continuing violence, a makeshift bomb killed a policeman south of Baghdad 
early today, while mortar fire hit northern and western areas of the capital, 
injuring another, an interior ministry source said.
