I don't want to stretch the issue, but I think you're missing the point.  
Obviously you can listen to the music.  To copy it and send it to another, 
though, is illegal.  Will that person get caught??  Probably not, but that 
doesn't make it legal to do.

Regarding using wav or midi files in stationary............if the files are in 
the public domain, there is no problem.  If they are not, they fall under the 
same laws as CD music - you cannot use them legally without paying the author 
the royalty.  The fact that people send them without getting caught has no 
bearing on the issue.  That's like saying many people do 75 on the freeway in a 
posted 65 zone, therefore it must be legal to do 75!  Not so!
