question, so then is it "legal" to bid/buy software on ebay? 
How would you
know if the original owner does not still have it on his/her 
computer?

The software I bought says it is new and the CD is still shrink 
wrapped.  Plus owner maintains it unregistered.  That's why I 
look at the seller's rating and only buy from sellers who have a 
99 or better.

Never been disappointed yet :-)
