Most spam nowadays is apparently sent by bots; computers that have
been taken over without the owner/user being aware of it. So, you'd
probably be both wasting your time and jumping on someone who has no
idea what you're talking about.
If the ISP is threatening the mailing list, then chances are that the
mailing list itself sent the spam; check that the spammer isn't a list
member, or that the list accepts messages only from members. If the
list accepts messages from non-members, that should be blocked ASAP.
The ISP *should* have reasonably competent people who can verify where
an email address came from.
Can you forward (as an attachment) a sample of the spam email and also
a sample good email? I can probably tell you what likely happened.
If it were so easy to bring spammers to justice, there'd be a lot
fewer spam emails.
