No Dave, you are right. RIAA threw a fit over blank cassettes for the
same reason that Chad stated. The court dismissed the case because
copying and not selling for profit, recouping your loss for the blank
tape is legal as well. Change in times and ideas (comparison to software
piracy) and the fact that the internet reaches much more than the 5-6 six
people that you would give a tape was the reason that Napster was ruled
against.

Hmmm, maybe I am wrong about Napster. The NET Act would make mp3 sharing
illegal if you expect to receive other mp3 in return. And the DMCA (1996)
is what allows RIAA to go after ISP, but requiring an ISP to monitor such
activity could cause a conflict with privacy laws and AHRA (1992) if the
material was BBS style of postings between friends or personal use. Truly
circle logic for the courts. But in the end, a strategic negative ad
campaign would stop RIAA cold.
