weird i just tested this . i do have recovery catalog but for purposes of this 
discussion i think that should'nt matter
legato  and oracle 9.2.0.8

new RMAN configuration parameters:
CONFIGURE DEFAULT DEVICE TYPE TO 'SBT_TAPE';
new RMAN configuration parameters are successfully stored
starting full resync of recovery catalog
full resync complete
RMAN> run {
