Well I tried with new opatch verion on my laptop windows which runs xp.

I have oracle 11.2.0.2 version installed and had same problem with this oci
even i tried to kill the process holding that but no luck.

The trick was to boot laptop in safe mode with networking unless you are not
administrator and run opatch it will work.
