Not trying to cause controversy here. Working for a large hospital in a major
metropolitan city I probably have legal resources, compliance teams, etc that a
private practice either does not have, or utilizes
I have no skin in the game here, except as a concerned OPS member and past
president of our organization, that we may be overstepping our legal scope of
practice in providing any type of advise of practicing outside that scope.
Am advising judicial caution for our organization only. Perhaps it might be a
good thing, given the times, to have this issue revisited ( as it was back in
the early 90’s) by whatever legal body the OPS employs. To see what liability
we might be exposing ourselves to in this regard.

Deja Vu, didn't we just do this a couple weeks ago?
Darrin has a point. Even that mediocre, outdated "disclaimer" says "...the
scope of practice of medical professionals has been established traditionally
on the state level..." So if it's legal in an OPS member's state & it's part of
their routine then they should be qualified to teach it. Including IV
injections & Phlebotomist's IV insertion...

BTW, that disclaimer is what killed any efforts of trying to take steps in
"legalizing" IV injections in not only our state but many others. A statement
of SUPPORT from our profession is needed & it "neither advocates or opposes" IV
injections.

I believe the BOD made decisions multiple times to avoid taking a position on
this issue given the legal ramifications
I know for a fact during Paul Montague’s tenure ( twice) as President he was
adamant on this point. That was the time that an official disclaimer was
placed on our website, after consultation with the attorney that he engaged. I
believe that disclaimer is still on our website?

Just curious- why do you need an RN to give this talk? I’m not trying to stir
things up, but for those of us that are legal to inject fluorescein in our
state, why not ask within the OPS? I’m sure that whoever gives the talk will
need to precede it with an OPS disclaimer.
