Not necessarily.
The nice thing about your proposal to use TTL is that this only
impacts the IP encapsulation server. That way, in principle,
you're not mandating the impossible -- that all routers in the
US become BF-aware.
But this also means that I can easily and legally configure my
routers not to increment TTL, and I've defeated the scheme. And
the router vendor has no simple way to prevent this, without
making the thing BF-aware (i.e. IF the packet is an ATSC packet
with BF set, THEN force TTL to <=3D4, and clearly even that can be
defeated).
*I* would be legally on very questionable grounds, but the
equipment vendors are essentially unable to stop me unless we're
back to making all routers aware of ATSC and its BF.
